TAX EXEMPTION
Ex-tariffs are regimes for temporarily reducing the tax rate on imports of capital goods (BK) and IT and telecommunications goods (BIT), aiming to relieve investments.
It is an instrument of Public Policy, being used to improve productivity, allowing access to technologies that are not yet available and in use by Brazilian industry. Ordinance No. 309, of 06/24/2019, established procedural rules for analyzing requests to reduce the import tax rate without equivalent national production, under the Ex-Tariff regime, considering needs to stimulate productive investment and in order to discipline the processes of applications, renewals, revocations, analyses, public consultations, challenges, concessions and rejections of claims.
On August 29, 2019, Ordinance No. 324 was published, detailing the criteria for the technical analysis of applications for the concession of Ex-Tariffs by SDCI-Secretariat for Development of Industry, Commerce, Services and Innovation of the Ministry of Economy.
JCS specializes in advising on claims for products in the electro-electronic and solar photovoltaic segments:
• Preparation of requests for concession, renewal, contestation and revocation of ex-tariffs.
• Submission of processes in compliance with the procedures of Ordinances No. 309 of June 24, 2019 and No. 324 of August 29, 2019.

INMETRO, FINAME AND PADIS
The registration of equipment, components and systems in Finame is carried out through the BNDES CFI platform and enables companies to sell their products in accordance with the financing lines that require accreditation. Photovoltaic modules and other components must be accredited by the manufacturing companies, Photovoltaic generating systems must be accredited by manufacturers or engineering companies with specific economic activity codes.
JCS carries out the accreditation of your company and products according to the criteria established by the "Regulation for the accreditation of machines, equipment, industrial systems and components" in its Annex 1: "Accreditation Methodology for Photovoltaic Generating Modules and Systems"
For products manufactured in Brazil, they may be eligible for incentives from the PPB-Basic Productive Process, with tax benefits on sales, we adapt products to the PPB and incentive policies. To comply with the new regulations for imports of photovoltaic system components , we register companies and objects with Inmetro, enabling direct import by companies that meet current requirements.
DUE DILIGENCE OF PROJECTS
Due diligence processes for the solar segment help companies assess technical risks in renewable energy projects.
This independent assessment is essential for the final analysis of projects by developers, owners and investors.
Our review targets the technical aspects of a project, including energy production estimates, equipment and technology, contract arrangements, project schedules and budgets, as well as future operation and maintenance costs.
The assessment may also include project site visits, equipment manufacturer audits, quality controls, detailed equipment inspections, construction monitoring, and verification of completion.
When considering all technical information, the result is a set of conclusions and recommendations that are relevant and appropriate for the project and the parties involved.
